BY ACCESSING OR USING ANY SERVICE PROVIDED BY THE OPTION HAVEN, INCLUDING THE DISCORD SIGNALS COMMUNITY AND/OR THE COPY TRADING SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS IN THEIR ENTIRETY. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE USE OF ALL SERVICES AND CANCEL YOUR SUBSCRIPTION.

 

1. DEFINITIONS

For the purposes of these Terms and Conditions, the following definitions apply:

"The Option Haven" / "TOH" / "we" / "us" / "our" refers to The Option Haven, its owner, operators, employees, contractors, and affiliates.

"Services" refers collectively to the Discord Signals Community and the Copy Trading Service, including all content, signals, alerts, commentary, analysis, and communications delivered through these platforms.

"Subscriber" / "you" / "your" refers to any individual or entity that accesses, uses, or subscribes to any TOH Service.

"Signals" refers to options trade ideas, alerts, commentary, market analysis, and any related content published through the Discord Signals Community.

"Copy Trading Service" refers to the service through which Subscribers may receive trade information for the purpose of replicating positions at their own discretion.

"Subscription Fee" refers to any monthly, quarterly, or annual payment made to access TOH Services.

 

2. NOT FINANCIAL ADVICE — EDUCATIONAL PURPOSES ONLY

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. READ IT IN FULL.

2.1  The Option Haven is an educational and informational service. Nothing published, communicated, or transmitted through any TOH Service — including but not limited to Discord messages, signals, alerts, analysis, commentary, voice communications, or copy trading data — constitutes financial advice, investment advice, securities advice, trading advice, or any other form of professional regulated advice.

2.2  The Option Haven is NOT a registered investment adviser, broker-dealer, financial planner, or any other type of regulated financial professional under any applicable federal or state law, including but not limited to the Investment Advisers Act of 1940 or any equivalent legislation.

2.3  All signals, trade ideas, and content are shared purely for educational and informational purposes. They represent the personal views and experiences of the publisher and must not be construed as a recommendation, solicitation, or offer to buy or sell any security, option, futures contract, or other financial instrument.

2.4  Subscribers must consult a licensed financial professional before making any investment or trading decision. The Option Haven expressly disclaims any duty or obligation to provide personalized financial advice.

 

3. COPY TRADING SERVICE — SPECIFIC DISCLAIMERS

3.1  The Copy Trading Service provides trade information for informational and educational purposes only. Subscribing to this service does not create a managed account, advisory relationship, or any fiduciary duty between TOH and the Subscriber.

3.2  Any decision to replicate, mirror, or otherwise act upon trade information received through the Copy Trading Service is made solely at the Subscriber's own discretion and risk. The Option Haven does not execute trades on behalf of Subscribers and has no control over the Subscriber's account, brokerage, or execution.

​

3.3  Execution prices, slippage, commissions, timing differences, broker restrictions, and account-specific factors will result in outcomes that differ materially from any results referenced by TOH. Past results published by TOH are not indicative of any individual Subscriber's results.

3.4  By accessing the Copy Trading Service, Subscribers expressly acknowledge that they are solely responsible for all trading decisions made in their accounts, regardless of the information received from TOH.

 

4. RISK DISCLOSURE & ASSUMPTION OF RISK

4.1  Trading options, futures, and other derivatives involves a very high degree of risk and is not suitable for all investors. Options trading can result in the total loss of the capital invested and, in certain circumstances, losses exceeding the initial investment.

4.2  By subscribing to any TOH Service, you expressly represent and warrant that:

(a)  You understand and accept the risks inherent in options and derivatives trading;

(b)  You are financially able to sustain the complete loss of any funds committed to trading;

(c)  You have sufficient knowledge and experience in financial markets to evaluate the risks of the information provided;

(d)  You are not relying on TOH as your primary or sole source of trading or investment information.

4.3  The Option Haven makes no representation that any signal, strategy, or trade idea will result in profitable outcomes. Markets are inherently unpredictable and past performance — whether real or hypothetical — is not indicative of future results.

 

5. LIMITATION OF LIABILITY

THIS SECTION LIMITS THE OPTION HAVEN'S LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

5.1  TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPTION HAVEN, ITS OWNER, OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH:

(a)  Any trading losses incurred by a Subscriber, regardless of the cause;

(b)  Reliance on any signal, trade idea, alert, analysis, or commentary published through TOH Services;

(c)  The Copy Trading Service, including any decision to replicate, mirror, or act upon information received;

(d)  Any interruption, delay, error, or failure of TOH Services;

(e)  Unauthorized access to or alteration of Subscriber data or communications;

(f)  Any other matter relating to TOH Services, whether based in contract, tort, negligence, strict liability, or otherwise.

5.2  IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF THE OPTION HAVEN TO ANY SUBSCRIBER EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY THAT SUBSCRIBER IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

5.3  Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, liability is limited to the fullest extent permitted by applicable law.

 

6. NO GUARANTEE OF RESULTS

6.1  The Option Haven makes no guarantee, representation, or warranty, express or implied, that any signal, trade idea, strategy, or information provided through TOH Services will result in profitable trading outcomes.

6.2  Any reference to past trades, historical results, win rates, or performance metrics is provided for illustrative purposes only and does not constitute a guarantee or prediction of future performance. Individual results will vary based on market conditions, execution, broker, risk management, capital, and other factors outside TOH's control.

6.3  Subscribers acknowledge that trading results shared by TOH or its community members may not be representative of typical Subscriber outcomes and may reflect exceptional, atypical, or selectively presented results.

 

7. SUBSCRIPTION, PAYMENT & REFUND POLICY

7.1  Access to TOH Services requires payment of the applicable Subscription Fee. All fees are charged in advance on a monthly, quarterly, or annual basis as selected at the time of purchase.
 

7.2  Subscription Fees are NON-REFUNDABLE. By completing your purchase, you acknowledge and agree that no refunds will be issued, including but not limited to situations involving:

(a)  Trading losses incurred during the subscription period;

(b)  Dissatisfaction with signals or results;

(c)  Failure to access or use the Services;

(d)  Early cancellation of a subscription.

7.3  Subscriptions will auto-renew at the end of each billing period unless cancelled by the Subscriber prior to the renewal date. It is the Subscriber's sole responsibility to manage and cancel their subscription.

​

7.4  The Option Haven reserves the right to modify Subscription Fees at any time with reasonable prior notice. Continued use of the Services after a price change constitutes acceptance of the new fee.

 

8. INTELLECTUAL PROPERTY

8.1  All content published through TOH Services, including signals, analysis, written content, graphics, branding, and methodologies, is the exclusive intellectual property of The Option Haven and is protected by applicable copyright and intellectual property laws.

8.2  Subscribers are granted a limited, non-exclusive, non-transferable, revocable licence to access TOH content solely for personal, non-commercial use. Subscribers may not:

(a)  Copy, reproduce, redistribute, resell, or republish any TOH content;

(b)  Share account credentials or provide access to any unauthorized third party;

(c)  Screenshare, forward, or redistribute signals or trade alerts in any form;

(d)  Use TOH content to build a competing service or commercial product.

8.3  Any unauthorized use of TOH intellectual property may result in immediate termination of the Subscriber's account without refund and may expose the Subscriber to legal liability.

 

9. CODE OF CONDUCT

9.1  Subscribers must conduct themselves respectfully within the Discord community and all TOH platforms. The following conduct is strictly prohibited:

(a)  Harassment, bullying, or threatening behavior toward any member or TOH staff;

(b)  Sharing or soliciting financial advice that contradicts the educational nature of the community;

(c)  Spamming, advertising, or promoting competing services;

(d)  Sharing account access with non-subscribers;

(e)  Any activity that violates applicable law or the terms of the Discord platform.

9.2  The Option Haven reserves the right to remove any Subscriber from any Service for any violation of this Code of Conduct, at TOH's sole discretion and without refund.

 

10. TERMINATION

10.1  The Option Haven reserves the right to suspend or permanently terminate any Subscriber's access to TOH Services at any time, with or without cause, and with or without notice, at TOH's sole and absolute discretion.

10.2  Upon termination, the Subscriber's licence to access TOH content ceases immediately. No refund of Subscription Fees will be issued upon termination, except where termination is solely due to TOH's unilateral decision without cause, in which case a pro-rated refund of prepaid fees may be provided at TOH's discretion.

​

10.3  Subscribers may cancel their subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused days in a billing cycle.

 

11. INDEMNIFICATION

By using TOH Services, you agree to indemnify, defend, and hold harmless The Option Haven, its owner, operators, employees, contractors, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of TOH Services; (b) any trading decisions made based on information received through TOH Services; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.

 

12. DISCLAIMER OF WARRANTIES

TOH SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. THE OPTION HAVEN DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

 

13. GOVERNING LAW & DISPUTE RESOLUTION

13.1  These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States of America, without regard to its conflict of law provisions.

13.2  Any dispute arising from or relating to these Terms or TOH Services shall first be submitted to good-faith informal negotiation. If unresolved within thirty (30) days, the dispute shall be resolved by binding arbitration in Virginia, conducted on an individual basis. Subscribers waive any right to participate in class action proceedings.

​

13.3  Nothing in this section prevents TOH from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

 

14. MODIFICATIONS TO TERMS

The Option Haven reserves the right to modify these Terms at any time. Updated Terms will be published with a revised effective date. Continued use of TOH Services after any modification constitutes acceptance of the revised Terms. It is the Subscriber's responsibility to review these Terms periodically.

 

15. ENTIRE AGREEMENT & SEVERABILITY

15.1  These Terms constitute the entire agreement between you and The Option Haven with respect to the subject matter herein and supersede all prior agreements, representations, and understandings.

15.2  If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

​

15.3  The failure of TOH to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

BY SUBSCRIBING TO AND/OR ACCESSING ANY THE OPTION HAVEN SERVICE, YOU CONFIRM THAT:

•    You have read and understood these Terms in full;

•    You agree to be legally bound by these Terms;

•    You understand that TOH does not provide financial advice;

•    You accept full responsibility for all trading decisions and outcomes;

•    You acknowledge the high-risk nature of options trading and accept that losses, including total loss of capital, are possible.
